Artist Upload & Content Distribution Agreement
Version 2.1 · Effective November 7, 2026 · 1919 Productions LLC, doing business as The Tape Stop
Parties: 1919 Productions LLC, doing business as The Tape Stop ("Company"), and the artist, DJ, producer, label, uploader, or other account holder ("Artist").
1. Binding assent
Artist accepts this Agreement by checking a separate, unchecked box before first upload. Company records the agreement version, account ID, timestamp, and relevant acceptance metadata. Artist has authority to act for all owners and collaborators represented.
2. Rights representations
For every upload and every enabled use, Artist represents and warrants that Artist owns or has obtained all required permissions, licenses, consents, and clearances in the sound recording, musical composition, samples, beats, featured performances, cover art, trademarks, and likenesses, including reproduction, distribution, synchronization where relevant, and public-performance rights. Artist further warrants that no upload is subject to an exclusive license, distributor, label, or beat-license term that prohibits hosting or streaming here, and that Artist has satisfied all royalty and contractual obligations. Artist will promptly notify Company if rights expire or are disputed.
3. No automatic exemptions
Mixtape culture, promotional intent, free distribution, a private demo, a small audience, a remix, a freestyle, attribution, or a peer-to-peer label does not itself authorize use of protected material. Fair use and other exceptions are fact-specific and are not decided by Company. Artist may upload only where a lawful basis exists for the intended uses.
4. Operational license
Artist controls available visibility and recipient settings, subject to Company policies and law. Artist grants Company a limited, nonexclusive, worldwide, royalty-free license to store, reproduce, transcode, transmit, stream, publicly perform, display, and make content available solely to operate Artist-selected features, standard on-platform discovery, and essential service operations. Company acquires no ownership of Artist's copyright and no right to sell Artist's recordings. Artist authorizes infrastructure vendors to perform these acts for Company. The license ends after deletion and reasonable technical and backup periods, subject to lawful preservation.
5. Artist responsibilities
Artist will keep evidence of ownership and licenses and give reasonable documentation on legitimate request within 5 business days. Artist must not circumvent takedowns, upload on behalf of banned accounts, falsely claim ownership, or use private links to evade enforcement. Artist is responsible for payments and clearances owed to producers, performers, publishers, and labels.
6. Rights disputes, removal, and disclosure
Company may remove or disable content, freeze related features, request documentation, or suspend accounts when required by law or reasonably necessary to address a claim. Removal is not an admission of infringement, and Artist releases Company from claims arising from good-faith removal. Artist may use the counter-notice process in the Copyright Policy but may not submit a knowingly false counter-notice. Artist consents to Company disclosing Artist's identity and contact information to a rights owner or its agent as the law or the counter-notice process requires, and to law enforcement under valid legal process.
7. Indemnity and defense
To the maximum extent permitted by law, Artist will defend, indemnify, and hold harmless Company, its affiliates, managers, officers, employees, and contractors from third-party claims, damages, settlements, judgments, and reasonable legal expenses arising from Artist's content, unauthorized use of rights, false ownership statements, or material breach. Company will give reasonably prompt notice and reasonable cooperation at Artist's expense. Artist may not settle in a way that admits fault by, or imposes nonmonetary obligations on, Company without Company's written consent, not unreasonably withheld. This does not cover Company's independent wrongful conduct.
8. No legal clearance or agency
Company is not Artist's legal counsel, rights clearance agent, publisher, or fiduciary. Metadata or moderation tools are not a certification of rights. Artist is not Company's employee, partner, or agent.
9. Remedies and survival
Company may suspend or terminate Artist accounts for violations or repeated infringement, subject to law. Rights warranties, indemnity for pre-termination conduct, release, dispute provisions, and accrued payment obligations survive termination. Liability limits and mandatory legal rights are as stated in the Platform Terms.
10. Incorporation; priority
The Platform Terms, Copyright Policy, Repeat-Infringer Policy, Community Rules, and payment disclosures are incorporated by reference. For Artist's uploads, this Agreement controls over the Platform Terms in a conflict.
